Texas executes a man with an IQ of 61 and the mental capacity of a 1st grader. He was convicted of murdering a man in 1992.
I believe the Texas man must be punished for what he did back in 1992. However, in the US constitution the provision of cruel and unusual punishment should have been implied in this case.
The US Supreme court ruling allowed the states to determine what the definition of a mentally handicap person in. If the man was in another state he would likely not have been executed.
A proper punishment would have been life in prison. That way he would never had a chance to kill again.
